As improvements in neuroscience have enabled a better understanding of disorders of consciousness as well as methods to treat them, a hurdle that has become all too prevalent is the denial of coverage for treatment and rehabilitation services. In 2011, a settlement emerged from a Vermont District Court case, Jimmo v. Sebelius, which was brought to stop the use of an “improvement standard” that required tangible progress over an identifiable period of time for Medicare coverage of services. While the use (...) of this standard can have deleterious effects on those with many chronic conditions, it is especially burdensome for those in the minimally conscious state, where improvements are unpredictable and often not manifested through repeatable overt behaviors. Though the focus of this paper is on the challenges of brain injury and the minimally conscious state, which an estimated 100,000 to 200,000 individuals suffer from in the United States, the post-Jimmo arguments presented can and should have a broad impact as envisioned by the plaintiffs who brought the case on behalf of multiple advocacy groups representing patients with a range of chronic care conditions. Two reports have shown that mammalian artificial chromosomes (MAC) can be constructed from cloned human centromere DNA and telomere repeats, proving the principle that chromosomes can form from naked DNA molecules transfected into human cells. The MACs were mitotically stable, low copy number and bound antibodies associated with active centromeres. As a step toward second-generation MACs, yeast and bacterial cloning systems will have to be adapted to achieve large MAC constructs having a centromere, two telomeres, and genomic copies of mammalian (...) genes. Available construction techniques are discussed along with a new P1 artificial chromosome (PAC)-derived telomere vector (pTAT) that can be joined to other PACs in vitro, avoiding a cloning step during which large repetitive arrays often rearrange. The PAC system can be used as a route to further define the optimal DNA elements required for efficient MAC formation, to investigate the expression of genes on MACs, and possibly to develop efficient MAC-delivery protocols. Les langues des signes sont des langues qui n’ont pas un système d’écriture qui leur est propre et qui, par leur nature visuo-gestuelle, ne peuvent pas être écrites phonographiquement. Les conséquences de cette « non‑scriptibilité » sont au centre des travaux menés à partir de 2000 par Elena Antinoro Pizzuto. EAP, décédée en 2011, mettait en évidence les biais que l’utilisation des « gloses », employées comme substituts de la transcription, induisent dans l’analyse linguistique des LS. Ces 10 dernières années, (...) les avancées technologiques et méthodologiques ont rendu plus aisée la saisie automatique des données corporelles, l’annotation multilinéaire de corpus multimodaux et le maintien des liens entre les annotations et les vidéos, ainsi que la diffusion des vidéos sur lesquelles se basent les analyses. Toutefois, ces technologies et bonnes pratiques — bien que fondamentales — ne font pas office de système de transcription : ce sont des solutions qui suppriment une partie des symptômes liés à la non‑scriptibilité des LS, mais ne comblent pas l’absence d’un système de représentation graphique de ces langues. Les questions soulevées par EAP sont donc encore d’actualité. Si différentes tentatives pour transcrire les LS ont vu le jour, leur utilisation pour exploiter de vastes corpus de LS s’est souvent heurtée à leur faible lisibilité et/ou requêtabilité. En comparant les avantages et les inconvénients de ces systèmes, il est possible d’établir une liste des caractéristiques que devrait posséder un système de transcription des LS. Mais développer un système qui réunit toutes ces spécificités est un défi que les linguistes ne peuvent pas relever seuls : c’est dans la pluridisciplinarité, et en particulier dans le travail conjoint avec les spécialistes des aspects graphiques de l’écriture, que semble résider la solution. This paper reflects on quality assessment and performance evaluation in higher education, namely by analysing the insufficient link between those two aspects. We start by reviewing the current state of the art regarding different processes and mechanisms of quality assessment and performance evaluation and discuss some of the major issues regarding the implementation of some of them. In particular, we analyse the current limitations regarding data collected, available and publicised on the performance of HEIs and the problems those limitations bring (...) to a fair evaluation of higher education. Through this analysis we intend to contribute to a better understanding of the mechanisms of evaluation in higher education and the way these may lead to the promotion of better quality assessment practices and institutional management. Animals are frequently utilized as a teaching-learning tool in multiple educational settings. It is, therefore, important to understand what students think about this topic, in particular medical and veterinary students as “life caregivers” and competent people for a dynamic and responsible social intervention. In this context, this research aims to characterize and disseminate a set of issues related to animal welfare/wellbeing in higher education in the North of Portugal, particularly as regards the teaching of students of the Integrated Master in (...) Medicine (MIM) and Veterinary Medicine (MIMV). After ethical approval, a survey was delivered on paper to 180 undergraduate MIM (n = 100) and MIMV (n = 80) students. After collecting 139 questionnaires partially or fully completed, with varying response rates for each question, it was concluded that most of the students consider that animal experimentation is ethically acceptable when the benefits balance the harms and assuming that refinement of animal procedures is warranted; they also agree to the establishment, maintenance and performance of animal procedures solely for educational purposes as a way of ensuring optimal acquisition of theoretical knowledge, attitudes and behaviors and technical skills. Nevertheless, it is the responsibility of teachers to explore and implement pedagogical methodologies thar are equally effective but more humane and compassionate towards sentient living beings. “The Bodhisattva’s Practice of Enlightenment” interprets a Los Angeles Times newspaper opinion piece by Thich Nhat Hanh as a contemporary image of enlightenment with far-reaching implications. Written in response to the brutal police beating of Rodney King and not intended for a Buddhist audience, this brief newspaper article nevertheless provides glimpses into the contemporary meaning of enlightenment. The chapter considers Thich Nhat Hanh’s comments in relation to the basic principles of Buddhist ethics before turning to the Vimalakīrti sūtra, a classical (...) Mahayana Buddhist scripture, to extend an understanding of what it would mean to experience the world through an in-depth awareness of “no-self.” Dwelling on the bodhisattva’s effort to cultivate generosity of spirit, the chapter considers the kinds of human relations that Thich Nhat Hanh’s sense of enlightenment entails. “Enlightenment and the Practice of Meditative Reading” examines the practices of reading and the critiques of reading that were common in the first few centuries of Chinese Chan Buddhist monasticism. Although interpreters frequently conclude that reading ceased to be a central practice in the institutions of Chan, classical texts show that, reading and writing were just as central to Chan practice as they had been in earlier forms of Chinese Buddhism. Because China’s culture of literacy inevitably extended into Chan practice, (...) a highly unusual and sophisticated theory of reading developed, while practices of reading aimed at enlightenment thrived. This historical realization raises questions about the relation between practices of meditation and reading, suggesting that our own practice of reading might be developed and deepened by learning to conceive of it as a form of meditative practice. Skepticism about the epistemic value of intuition in theoretical and philosophical inquiry fueled by the empirical discovery of irrational bias (e.g., the order effect) in people's judgments has recently been challenged by research suggesting that people can introspectively track intuitional instability. The two studies reported here build upon this, the first by demonstrating that people are able to introspectively track instability that was experimentally induced by introducing conflicting expert opinion about certain cases, and the second by demonstrating that it was (...) the presence of instability?not merely the presence of conflicting information?that resulted in changes in the relevant attitudinal states (i.e., confidence and belief strength). The paper closes with the suggestion that perhaps the best explanation for these (and other) findings may be that intuitional instability is not actually ?intuitional.? (shrink)

According to some theories of testimonial knowledge, testimony can allow you, as a knowing speaker, to transmit your knowledge to me. A question in the epistemology of testimony concerns whether or not the acquisition of testimonial knowledge depends on the speaker's testimony being sincere. In this paper, I outline two notions of sincerity and argue that, construed in a certain way, transmission theorists should endorse the claim that the acquisition of testimonial knowledge requires sincerity.

The Religion of Humanity, first expounded by the founder of Positivism, Auguste Comte, focused the minds of a wide range of prominent Victorians on the possibility of replacing Christianity with an alternative religion based on scientific principles and humanist values. “Enlightenment and the Moral Dimension of Zen Training” responds to critical accusations that the roles played by some Japanese Zen masters in the Second World War were morally deficient. The criticism extends to the allegation that their enlightenment did not prevent these Zen leaders from active participation in the nation’s ruthless military aggression against neighboring countries and that after the war some Zen masters made public statements that expressed an inexcusable indifference to the pain and suffering their actions helped cause. (...) This chapter thus inquires into the role of morality in Zen training and finds that concern for morality does not play a substantial role in Zen training. The chapter also evaluates what that realization implies about the character of enlightenment in Zen and concludes with open suggestions about how Zen practice might expand to more effectively encompass the moral sphere of human life central to the Buddhist tradition. In Wittgenstein: On Rules and Private Language, Saul Kripke argues for an extreme form of meaning scepticism. One influential reply to Kripke’s arguments was developed by David Lewis. The reply developed by Lewis makes use of the notion of mind-independent relations of similarity and difference. The aim of the paper is to argue that Lewis’ reply is not satisfactory: the challenge to find a refutation of Kripke’s sceptical arguments remains unmet.

This paper replies to Peter Millican (Mind, 2009), who argues that Hume denies the possible existence of causal powers which underlie the regularities that we observe in nature. I argue that Hume's own philosophical views on causal power cannot be considered apart from his mitigated skepticism. His account of the origin of the idea of causal power, which traces it to a subjective impression, only leads to what he calls ‘Pyrrhonian scepticism’. He holds that we can only escape such excessive (...) skepticism by way of a natural judgment based on the association of ideas, which forms the basis of what he calls ‘a legitimate ground of Assent’. . The origin and history of Landauer’s principle is traced through the development of the thermodynamics of computation at IBM from 1959 to 1982. This development was characterized by multiple conceptual shifts: memory came to be seen not as information storage, but as delayed information transmission; information itself was seen not as a disembodied logical entity, but as participating in the physical world; and logical irreversibility was connected with physical, thermodynamic, irreversibility. These conceptual shifts were characterized by an ambivalence opposing (...) strong metaphysical claims to practical considerations. Three sorts of practical considerations are discussed. First, these conceptual shifts engaged materials central to IBM’s business practice. Second, arguments for metaphysical certainties were made with reference to the practical functioning of typical computers. Thomas Nagel has held that transcendence requires attaining a point of view stripped of features unique to our perspective. The aim of transcendence on this view is to get at reality as it is, independent of our contributions to it. I show this notion of transcendence to be incoherent, yet defend a contrasting notion of transcendence. As conceived here, transcendence does not require striving for an external, objective viewpoint on nature or looking at matters from someone else's or an impartial (...) point of view. On my view, which builds on the work of Iris Murdoch, transcendence consists of a refinement of our concepts and sensibility to make them more adequate to the individuals we encounter. “Enlightenment and the Experience of Karma” analyzes this traditional Indian and Buddhist moral/ethical concept in order to assess the role that it might play in a contemporary culture of enlightenment. Elucidating five dimensions of this moral principle where questions can be raised by means of critical inquiry, the chapter strives to articulate a naturalized conception of karma that could conceivably play an important role in future global society. In order to do that, it reflects on the traditional connection between karma (...) as a moral principle and rebirth as a religious concept and asks what it might mean to develop a karma-based morality without a necessary link to any traditional understanding of afterlife. The chapter aspires to develop elements implicit in the traditional Indian idea of karma that could provide a basic structure for the human moral practice that is essential to any society and any quest for enlightenment. I argue that Philosophy as a Way of Life (PWOL) represents a distinct pedagogy that differs from philosophy’s signature pedagogy because of PWOL’s differing views of what philosophy is and how it is successfully practiced. I further argue that this pedagogy is radical in two senses. First, PWOL is technically radical because it naturally incorporates cutting-edge pedagogical techniques that promote student success. Second, I argue that PWOL is transformatively radical because it seeks to transform students’ understanding of themselves and the (...) world around them. Following this argument, I discuss my own experiences implementing a PWOL-based course as a case study of PWOL’s radical nature. (shrink)

The question which motivates this paper concerns the source of the concept of identity fundamental to Hegel’s system. This concept is expressed as follows: the identity of identity and nonidentity. This articulation of the principle of speculation, or speculative reason, is found in Hegel’s first publication, Differenz des Fichteschen und Schellingschen Systems der Philosophie. In this work Hegel seems to side with Schelling against the concept of identity formulated by Fichte in his Grundlage der gesamten Wissenschaftslehre. Here Hegel’s support for (...) Schelling’s concept of Indifferenz might lead us to assume that this is the source of Hegel’s concept of identity. However, to proceed on this assumption would be not only to overlook the continuity in Hegel’s own development as a thinker but also to lose sight of the kinds of concerns which, for Hegel, give rise to the need for speculative reason. Although Levinas did not write about The Merchant of Venice, recent scholarship has explored Levinasian themes in the play. However, most of The Merchant instantiates not Levinasian ethics per se, but the cultural and other forces that work against ethics. In particular, theodicy, which Levinas sees as morally scandalous, is deployed by Christian characters to justify their ill-treatment of Shylock. A surface reading of the play would suggest that it is structured around clear binaries, with Christian “mercy” juxtaposed to legalistic, (...) vengeful Jewish “justice.” However, a more nuanced reading, particularly one informed by Levinas’s philosophy, reveals ways in which Shakespeare seems to call these distinctions into question, and uncovers two genuinely ethical moments in the play: Shylock’s “Hath not a Jew eyes?” speech, and his implied, biblically informed critique of the treatment of slaves by Christians in Venetian society. This essay results from a common interest in the history of emotions shared by an academic with appointments in philosophy and psychiatry (Charland) and a literary historian (White). Where our interests converge is in the early modern concept of 'the passions,' as explanatory of what we now call mental illness. The task we have set ourselves is to see how this might: (a) be exemplified in a 'case study' of the dramatic revelation of Leontes's jealousy in the first half of (...) William Shakespeare's The Winter's Tale, and his 'cure' which takes sixteen years. Both events have troubled literary critics as implausible, lacking in realistic motivation, and clumsy as narrative devices, but can be explained in terms of theories of the passions ; and (b) open up a greater, modern understanding of irrational, pathological states, their onset and termination, by using as an explanatory model the early modern understanding of passions as revived and refined in the nineteenth century by Théodule Ribot. Janus-like, this chapter faces into the past and the future (our present) via a play written in 1610 that is still performed to receptive audiences today. We hope to show that the theory can illuminate a playtext, and that the play can revivify the theory, and to contend that historical analysis can shed light on modern clinical problems. The particular historical distinction which lies at the heart of our approach derives from early modern terminology offered by Thomas Wright in his book, The Passions of the Minde in Generall (first published in 1601; corrected, enlarged and augmented in 1604), and presented in more modern fashion in the nineteenth century by Théodule Ribot, in his La Psycholgie des sentiments * We dedicate this essay to Philippa Maddern, whose inspiration has generated so much inter-disciplinary research in the history of emotions and has brought so many like-minded scholars into fertile contact—in our cases, linking Western Ontario and Western Australia. This contribution showcases the work of the Vienna Euchologia Project which aims to make accessible the ‘small prayers’ or ‘occasional prayers’ that are preserved in the Byzantine euchologia manuscripts from the late 8th to the mid 17th century as sources for daily life and social history. A brief introduction to the project is followed by three thematically focused studies that juxtapose the prescriptive prayers in the euchologia with descriptive evidence from other sources: exorcism and other prayers in hagiographical narratives, prayers (...) with relevance to political history, and prayers relating to women’s purity. In view of the excellent arguments that have been put forth recently in favour of qualia, internal sensory presentations, it would strike an impartial observer - one could imagine a future historian of philosophy - as extremely odd why so many philosophers who are opposed to qualia, that is, sensory experiences internal to the brain, have largely ignored those arguments in their own. There has been a fashionable assumption that any theory of perception which espouses qualia has long since been (...) overcome by a number of 'formidable' objections, in particular, the Homunculus/Infinite Regress Objection, the Solipsism Objection, Austin's Illusion/Delusion Objection, the Ludicrousness-of-Colours-in-the-Brain Objection, the Indirect-Realist-has-to-assume-Direct-Realism Objection, the Impossibility-of-Comparing-Internal-with-External Objection, the Impossibility of Intrinsic Experience, and several more minor varieties of these. It is uncanny how they continue to be repeated, indeed, with a kind of automatism, evidenced by the fact that none of those who repeat them appear to have taken note of the answers to the objections. Indeed, they only appear to refer to those philosophers with whom they agree: it has long been insisted upon in the study of rhetoric that one of the weakest things to do in an argument is to ignore the main points made by one's opponent: [it is] the wisest plan _to state Objections in their full force_ ; at least, wherever there does exist a satisfactory answer to them; otherwise, those who hear them stated more strongly than by the uncandid advocate who had undertaken to repel them, will naturally enough conclude that they are unanswerable. It is but a momentary and ineffective triumph that can be obtained by man. (shrink)
